PORT CHESTER, NY, UNITED STATES, August 10, 2026 /EINPresswire.com/ -- "Artificial intelligence" now appears in roughly one of every 20 new U.S. trademark applications, nearly triple its share two years ago, according to the "State of Trademark Filings" report released today by GleanMark. And 65.4% of those are intent-to-use filings against 48.2% for everything else: companies are naming AI products they have not built yet.

The report accompanies GleanMark's launch. Ask a U.S. trademark attorney about their tools and the same complaints come back: a clearance search that arrives as a 500-page PDF someone still has to read; office action responses that eat a day of legwork; and uspto.gov open in a browser tab "constantly." The new AI tools add a different problem: invented case law an attorney must fact-check.

GleanMark puts that work under one roof: research, clearance, office action drafting, watching and deadlines, with every answer drawn from the actual USPTO record and every decision left with the attorney. Research that took hours takes seconds; a clearance analysis comes back in minutes, not days.

Clearance that shows its evidence

GleanMark Clearance is built for the analysis that decides a filing: a Section 2(d) likelihood-of-confusion review the attorney reviews, adjusts, and issues under their own firm's name. It shows why each conflict surfaced — exact match, near-identical spelling, sounds alike, shared element, foreign equivalent — rather than returning just a score, then gives citation histories for the marks that matter. It reads closely similar dead marks too, showing the prosecution problems they ran into. A separate registrability screen covers descriptiveness, surnames, geographic terms, and names of living people used without consent.

An office action response drafter that argues from the record

GleanMark's Office Action Response Drafter produces the first take a firm would assign to a junior associate: an attorney-reviewed draft response to a Section 2(d) or related refusal. Unlike tools that generate fluent argument and stop, it backs each argument with the prosecution record — real third-party registrations, crowded-field evidence, coexistence examples and events the attorney can verify, not citations a model invented. An honesty gate works both ways: it withholds arguments the record cannot support, and flags thin evidence.

Markus: an AI that knows the register, not just the law

General AI models can recite the du Pont factors. They cannot tell you what is actually on the register. Markus answers plain-English questions from the live record — an opposer's real extension-to-opposition history, how crowded a mark's field is, the phonetic conflicts a literal search misses, which docket items are already overdue. Every answer carries checkable serial numbers, none invented — and when the record cannot support a statistic, Markus declines to produce one.

Also included: automated deadline tracking, fast-track portfolio onboarding, branded client reports and watch alerts. Pricing is public and self-serve: a free USPTO search, no account required, and plans from $99 a month with no sales call and no seat minimums.

"Clearance and office action responses are where trademark practice gets hard and where the bills get big," said Howard Katzenberg, Founder of GleanMark. "Most tools hand you a confidence score and call it clearance, or a generated argument and call it a draft. Neither shows its work. When the record does not support an argument, our tools say so instead of inventing one."

"We handle trademarks for several thousand clients, and at that volume staying organized used to be most of the job. GleanMark keeps the whole portfolio straight and tells our clients automatically when something moves on their file. Clearance and day-to-day research now live in one place instead of across multiple vendors, and GleanMark's prosecution summaries and overall visual experience are exceptionally useful. We run a more organized practice, our clients hear from us before they think to ask, and everything is included in one monthly fee." — Jeff Stoller, J. Stoller Law
